Man dies after being put in a chokehold by another rider on New York City subway

Manhattan prosecutors are conducting a “rigorous ongoing investigation” into the death of a man seen in video being put in a chokehold by another rider on the New York subway after the man shouted at passengers.

Jordan Neely, 30, died Monday due to “compression of neck (chokehold),” a spokesperson for the New York City Office of the Chief Medical Examiner said. The manner of death was ruled a homicide, but that determination is not a ruling on intent or culpability, which is for the criminal justice system to consider, the spokesperson said.

This guy is going to be charged with murder.. There is no right to self defense or defense of others in NYC.

The Breadtubers/grifters are trying to make it seem like this marine just choked him to death for panhandling. No mention of him having a psychotic fit, threatening the entire train. And no, he didn’t deserve to die, but I doubt the intent of the marine was to kill him.
 
New York Gov. Kathy Hochul on Thursday said Neely’s family “deserves justice” and that there have to be consequences after his death.

“I do want to acknowledge how horrific it was to view a video of Jordan Neely being killed for being a passenger on the subway trains,” Hochul said at a news conference.

My gosh, did the New York Governor really say something so stupid? He was not killed for being a passenger on the train, he was killed because he was threatening everyone else on the train.

Neely did not deserve to die, but let's not pretend he was just an innocent man killed for no reason. Subway trains are tight, enclosed spaces. I'm sure that everyone on that train was scared out of their minds being trapped with this guy. When he screamed "I don't care if I get a life sentence" it is not unreasonable to think that he is willing, if not intending, to commit violence against other passengers.

One of the other passengers on the train is quoted as saying "None of us who were there thought he was in danger of dying, we just thought he passed out or ran out of air. That's understandable, but it also needs to be taken into account that a former Marine had to have known the risks of putting Neely into that particular hold, and holding him there for so long. Is there really no other hold he could have used to subdue Neely? I'm not saying he wanted to kill Neely, but it seems likely that he knew what he was doing could kill Neely, and still chose to do it anyway. It was obviously a high-pressure situation, and I can understand that when threatened with violence, and seeing others threatened with violence, this guy just snapped. We'll see how sympathetic a jury he can get in NYC.

Chokeholds are dangerous - which is why police aren't allowed to do them any more. But this guy wasn't a police officer and I'd bet he was simply trying to subdue, not kill, and he was doing what he was trained to do in the military. But when someone dies accidentally, especially if it was a black man, and it was due to the actions of a police officer or white guy, it triggers the dregs of society to come out to protest, chanting "no justice, no peace", and Rev Al starts yelling and marching - regardless of intent, facts, context, circumstances, etc. It's another example of white supremacy and we must get in the streets to demand justice (injustice).

They had 3 guys. You roll the bum over on his stomach, 1 sits on his butt, 1 pushes down on his shoulders, and 1 holds his legs down. Breathing isn't compromised, blood flow isn't limited, and everyone walks away alive with no charges. But, that's easy to say sitting in a chair and not there living it.

There’s rumblings he tried to push someone onto the tracks over the weekend and that’s how he was recognized.

If the deceased was in your county, you would know him. You would know what troubled him. You might have a pretty good idea as to what would set him off. You’d know his family. You’d have a sense of compassion and RESTRAINT if you saw him acting out. You’d get involved, get him under control.

And, since you’d know him, and his family, you’d be distressed about someone feeling the need to choke him out.

Why the race to pick sides? Sounds tragic. I hope the Marine gave this guy a chance. Choking someone out is dangerous business…death looks a lot like compliance.

You can’t cause injury or kill someone without a legal excuse...sounds stupidly simple. But you start there. So, what is the legal excuse?

What I’ve read about this…sounds like the deceased is acting in a way that would bother people, and frighten people as to what he MIGHT do. What DID he do? Sounds like not a whole lot. Self defense is THE legal excuse that must be considered. Doesn’t look like self defense to me…of himself or others.

Intent of the Marine? Seems like he doesn’t intend to kill…maybe not even injure. But someone’s dead.

Looks like a manslaughter charge to me.

Toxicology report of decedent matters greatly. They ignored it for Satan's Saint George. Will they obscure this one ?
In a case where most/all of this is likely on video, it matters…but a jury will see (probably) pretty clearly what the Marine saw. So, the tox won’t matter as much.

I agree with you. I am concerned about ensuring fair treatment for the mentally ill however. Our record on fair treatment and care of the institutionalized hasn’t always been great.
