Girard speed trap

Any Youngstown regulars…

In the mail today, I received notice of a speed infraction in Girard on I-80...75 in a 65. Always thought there was a ”gentleman’s agreement“ that up to 10 miles over was OK and I set my cruise control at plus 9 or plus 10. As I’m in this area regularly…anyone know what Girard‘s speed trap is set at?

I do live out this way, and thought 9 was ok, but 10 and over they could get you. Do you lease or own your vehicle?
 
Own…and I’m well aware of the hoops they have to jump through to get their money if it’s a camera ticket.
I asked because if you lease, it goes on the lenders end, and they tack it on your car payment. If you own, you can probably just not pay it. They will send to collections, but not much they can do about it

Right…it‘s a civil infraction. It is not financially sensible for the city to expend effort to collect on someone with one or a few of these infractions. But if you’re tagging everyone on I-80 going just 10 over, the volume must be incredible. In that stretch, 75 is a minimum.

I have a buddy, that has 11 of them, and said he hasn't paid a cent. Lol.
 
1. I thought they weren't allowed anymore to use the speed cameras on interstates, like I-80. They originally were but then I thought some state law changed that provision...maybe not, I can't keep up with some of this stuff. It's possible that municipalities (cities, like Girard) are still allowed, but that townships (such as neighboring Liberty Twp. and Weathersfield Twp.) are not allowed.

Liberty Township cameras operate on Route 11 north of Tibbetts-Wick Road from an overpass that carries Anderson-Morris Road. Keep these two locations in mind as you travel through the area.

As long as there is a time and place to “fight” the Ticket I’m pretty sure this practice is legal. If No Date,Time,Place(Court) to “fight” then not legal and don’t have to pay. This my understanding from Elmwood Place just outside St. Bernard in SW Ohio.

Going back about 5 or 6 years now, a class action lawsuit against Girard and their speed cameras arose from a road construction situation on a stretch of I-80 thru Girard whereby lanes were being added to I-80 to make it 3 lanes in each direction and a complete "full-depth" reconstruction of the existing roadway was also part of the project. Traffic maintained on the freeway during construction was temporarily reduced to a 55-mph limit, but after construction was substantially completed and the limit returned to 65-mph, at least one sign remained showing a 55-mph limit, which Girard was apparently relying on to issue camera tickets. As I understand it, there is a process by which drivers can contest a speed camera ticket, by appearing before an appointed "hearing officer" who has hours one weekday evening each week. I have no information as to what the volume is, or what success or failure people have that attempt to contest their ticket.
 
The last I heard, the Ohio house passed a bill requiring an officer to be present at all traffic citations. I do know something must have changed in the last year though as Dayton has fired their red light camera program back up.

I think there are a lot of court cases involving Girard on this matter .
I was one of the drivers that was shook out on July 25th, this is how I see it based on my experience. I was cited for 12mph over on I80 (Interstate Hwy), I received a $125 fine, they make it known that you will not receive points on your license, nor would the Bureau of Drivers licensing be contacted. This is explained by the outdated flyer they enclose in you notice by mail. They bank on this so the ppl cited just pay the fine, which I would suspect includes many from out of state who do not want to drive back for a hearing. The flyer describes how speeding is the cause of highway accidents, and the intent is to slow ppl down based on the word safety. I agree in part, however; there is also something called "Funding Generated Enforcement", which this is, in lament terms you can call it Poaching or Cherry Picking. Especially when the Ohio Patrol is most probably the entity that is investigating the traffic accidents on this stretch of Hwy, yet Girard City stands on a catwalk and hammers ppl on an Interstate Hwy for 10mph over the posted limit. Everyone on the highway is going 10 mph over, I would say including them when they are off duty. So, how can I defend this ordinance violation, yes, an ordinance violation for speeding, not a State Law Violation which it is meant to be. If they want to slow ppl down, then park a patrol car on this stretch of highway and everyone is slowing down. Oh, but wait, it's an Interstate Highway where the OHP covers. If you read their ordinance, (Maximum Speed Limits 333.03) it goes into detail about Royal Freeways and Royal Expressways, no mention of an Interstate Highway at all. So, your now in a bicker on definitions. Then, the officer's become complacent and doesn't even enter the subsection of the ordinance on the citation which runs from A thru J, I believe this has become a habit due to the volume of citations being issued. The block indicating location says I80 on my civil citation, nothing indicated about a Freeway or Expressway. Is this a defense? I don't know, is it a Formal Defect to the content of the citation or is it an informal defect? The only way to find out is to request a hearing which I did. So, on the day of court to my surprise there were at least 35 ppl that showed up for a hearing. (I believe many more just plead guilty and paid the fine). How long would it take to hear 35 cases? More than 1 Day, most probably a week. So, what's the process, they call it a compromise, if you plead guilty to the speed between 10-15 mph over you pay $40, 15-20mph over is $50, anything over 20 is no compromise. Half the room including myself raised their hand and accepted the fines. Now if you contest the ticket, you do not receive a compromise and you will have to present a defense. Would you take the chance on losing your appeal at $125, or just pay $40 and be done with it. This is a well-oiled machine for nothing more than Funding, nothing is about the safety of motorists based on how they are utilizing an ordinance for speeding violations, especially when OHP is the most probably entity that is investigation crashes on the Interstate that happens to run through the City Limits. They are generating massive funding by what I call Poaching in another's jurisdiction (OHP) for the purpose of easy money. The law is the law, 10mph is the rule, but common sense might say give a little more like 15 mph over. The State of Pennsylvania says 6 mph over by the use of radar which you would be hard pressed to find a Trooper in that state enforces a 6 mph over speeding law. Good Luck ppl, they don't need to post signs indicating a traffic camera with a handheld device, they can hang from the tree's or whatever they want to do to get you. Just as an FYI….CatAlum is no longer with us. He passed away over a year ago.
 
I’m doing great. Hope you’re doing well. I’ve made a few trips home to Warren recently. Gonna try to get inside the new field house one of the times I’m in town.
I'm doing great! I haven't been inside the new facility, but it is beautiful from the outside. When you come to town for a game, let me know. Maybe we can get a drink at the BV also.
