You think it was possible to miss him considering the distance he was away, then she accelerated?? Pay attention to point#2....." She fired her gun trying to barely miss the officer trying to detain her for criminal suspicion and scare him while she escaped .....oops it hit him!" Doesn't matter the officer has every right to fire back, whether the bullet misses or not. Think about that.

I am not arguing if he had the right to shoot or not. I don't think she was attempting to kill him. Otherwise she would not have attempted to miss him. And again, he was really dumb to stand in front of a car of a suspected petty thief.

You think he knew her entire police record at that point? That was the best angle to protect his partner watching her closely. Furthermore since she was only a suspected "petty thief" did he have reason to believe she would run him over to escape? I can find flaws in your opinion and so will the defense. He had every right to shoot her once she "accelerated" the vehicle as a weapon to escape, thats all that will matter.

Furthermore since she was only a suspected "petty thief" did he have reason to believe she would run him over to escape? I can find flaws in your opinion and so will the defense. He had every right to shoot her once she "accelerated" the vehicle as a weapon to escape, thats all that will matter.
You are making an argument I am not making. And, anything can happen in court.
 
These sensitive posters ought to stop fast forwarding this officer into court. The BCI investigation may conclude that every thing he did was totally lawful.
 
Yours is not the legal standard for detaining to investigate. His is.
Tried to help him get to PC then ARREST so that he could babble more about ILLEGALLY RESISTING ARREST. Since you seem to be aware of some legal standard or whatnot, did you think that she resist arrest/at what point?

As she was not under arrest, no. Was she guilty of Fleeing and Eluding, absolutely yes.

Not sure what you're looking for. She was not free to leave, period. In spite of the officer being really stupid tactically by standing in front of the car, she committed an additional crime by driving the car toward him.

You are not permitted to flee over the top of a police officer’s body. Making the moves towards accomplishing that is where she becomes a felon.

She was in the attempt phase of the misdemeanor. Never had a chance to “elude”….
 
Resisting arrest is illegal, for good reason. To protect the public is reason #1. A police officer should be able to use ANY means possible to arrest a suspect/criminal. You simply can NOT have a law abiding society otherwise which for obvious reasons is unacceptable to the majority who obey the law and pay taxes to uphold it. We can't have criminals/suspects just say "sorry officer you're not arresting me today" Who in the **** thinks that is a good idea? I'll tell you who CRIMINALS thats it!

Its illegal to resist go ahead tell me otherwise??? So i can physically detain you and if i feel threatened you may take my gun or harm me you get shot Legally! End if story go home .
