F. Update of OHSAA Legal Issues/Infractions
The Board was provided with a list of schools that recently violated OHSAA bylaws or sports regulations.
Dayton Christian School’s (Miamisburg) 7th-8th grade volleyball team had five students violate
Sports Regulation 6.5, Participating in Non-Interscholastic Programs Outside the Interscholastic Season -
Team Sports, when they participated in non-interscholastic competition in violation of the 50 percent rule in
seven matches after the season ended this fall. As a result of the infraction, the OHSAA has declared the students
ineligible for seven regular season volleyball matches for the 2012 season. Richmond Heights High
School’s girls varsity basketball team had a student-athlete violate Bylaw 4-4-1, Scholarship. In accordance
with Bylaw 10-2-1, Forfeitures, the school must forfeit a victorious contest in which the ineligible student
participated. Dayton Thurgood Marshall High School’s boys basketball team had a student-athlete
violate Bylaw 4-7-2, Transfers. In accordance with Bylaw 10-2-1, Forfeitures, the school must forfeit three
victorious varsity contests and four victorious junior varsity contests in which the ineligible student participated.
Two student-athletes transferred to Powell Olentangy Liberty High School prior to the school
year. The students met the requirements of Exception 1 of Bylaw 4-7-2, Transfers, but the school failed to
submit Affidavits of Bona Fide Residence and request an eligibility ruling as required. The OHSAA restored
eligibility for the students retroactively and prospectively but, in accordance with Bylaw 4-1-1,
Administrative Error, the school has been fined $100.
Steve Craig, the OHSAA’s legal counsel, also provided the Board with an update on cases that are in litigation
B. 2012 Referendum Items
The Board was provided with a draft of proposed referendum issues that reflect changes to the OHSAA
Constitution and Bylaws. Associate Commissioner Deborah B. Moore reviewed the proposals. The Board and
staff had been reviewing these proposed changes, and it was recommended that these four issues be placed
up for referendum vote of the membership. If placed up for referendum by the Board, OHSAA member
schools will vote on the proposals between May 1 and 15, 2012.
1.) Constitution 5-6-1, Powers and Duties of the Board of Directors — Adds as part of the powers
and duties of the Board the ability to suspend membership of a school from the Association.
2.) Bylaw 4-3-4, Enrollment and Attendance (Semesters) — Adds the notion that a student who
does not attend any school for a semester(s) due to withdrawal shall have that semester(s) count in the total
of eight that are permitted.
3.) Bylaw 10-2-1, Forfeiture (Exception) — Rewords the exception by saying that if a student participates
in an athletic contest and his or her eligibility has been established by falsified information, the student
shall be declared ineligible (see Bylaw 4-1-2), but forfeiture of the contest may not be required. Using
“may” rather than “shall” leaves the OHSAA Office with discretion to still require forfeiture(s) in the event a
school does not do its due diligence or has been complicit with the falsification.
4.) Bylaw 11-1-2, Penalties — Increases that maximum amount in which the OHSAA could fine a school
per occurrence for violation of the OHSAA Constitution, Bylaws and Regulations as imposed by the
Commissioner’s Office to $10,000, which hopefully will serve as a deterrent and would be used in the most
egregious cases.
Motion by Phil Stevens, second by Ron Bond to approve New Business Consent Items VI. A. and VI. B. as
presented, which included placing the four proposed changes to the OHSAA Constitution and Bylaws up for
referendum vote.
Motion passed 9-0.
K. Bylaw 4-7-2, Transfers, Mr. Peter Lyell, Athletic Director, re: A 12th-Grade Student, Toledo Rogers High
School (Northwest District)
At the October 20, 2011, Board of Directors Meeting, the Board heard an appeal for a 12th-grade student
who transferred from Toledo Whitmer High School to Toledo Rogers High School during the 2010-11 school
year. As a transfer student, the student became ineligible for interscholastic athletics for one year from the
date of enrollment at Rogers, and the Commissioner’s Office determined that none of the enumerated
exceptions to Bylaw 4-7-2, Transfers, were applicable. The student and his parents, Lisa Dunnavant and
Cliff Gaston, and the school’s athletic administrator, Peter Lyell, appealed the ruling so that the student can
participate in interscholastic athletics at Rogers immediately. The parents testified that this move was not
done to circumvent the transfer bylaw. Following the appeal, the Board of Directors voted to table the
appeal.
After readdressing the appeal at this meeting, motion by John Ault, second by Phil Stevens to deny the
appeal.
Motion passed 7-0 (Bill Axe and Jenny Penn abstained).
