St Xavier HS Staffer Charged with Sexual Battery

I am not sure what to think about this situation. On one hand she is an adult (42 years old, married, has kids) and the student was 17 years old when this happened, which in Ohio you only have to be 16 to consent. Obviously she made some very bad decisions. Maybe because he is a male and not a female the optics seem different. Is the Prosecuting Attorney is going to be able to prove he was never a willing participant? What from I can understand the student is now 18 years old so if this goes to trial it will be in regular court (not juvenile).

That is incorrect, she was not a teacher. She worked in the Learning Center as a Tudor. She didn't teach any classes at StX. The local media has failed to provide all the facts. It sounds like a lot lot of the students have known about this for a long time. Something doesn't add up. Again, she had no authority over grades, strictly a Tudor in the Learning Center.

yeah but this is private school. Rules don't apply.

Boom shaka lacka.

First vouchers. Now, they're trying to create tax supported, legalized sexual healing in private schools. Public schools don't stand a chance in Sin Huffman's state.

Much like pit bulls attacking toddlers, this happens, has happened, and continues to happen, and will continue to happen. I really struggle with the term "sexual abuse" and "sexual battery". Call me crazy but when it's adult female, student male, most dudes would never stop this from happening. Is it wrong, absolutely. Should she serve 15 years for this? No.
Needless to say if you're 42 with a family and you're after a high school boy there's some issues going on. But don't we see movies and shows that glamorize this conduct? Cougars I believe is the term. My guess is it gets plead down, she'll never work in a school again and there will be a suspended sentence w/ community service. Odd that there has been no photos of her out there.

The only way that happens is if the victim becomes uncooperative. Otherwise, no pleas from a felony occur in these situations. She is going to prison.

You don't have to exaggerate your disdain for private schools.

I didn't. You don't have to presume disdain in order to snowman rather than struggle with what the reality might be.

I don't have disdain for private schools. I've never advocated government should forbid private education. I might not jump in the air to catch a bullet for that cause, but I'd open my mouth from a safe distance.

OK, full disclosure, I've never been a religious separatist. I don't fully respect social separatists generally of any order, even when I do it but I do believe people should have that choice as long as it's not infringing on anyone elses. I see pragmatism but oxemoron in the terms "chartered nonpublic school." If a school is not taking tax dollars, the state having say over or any monitoring of the curriculum is bothersome. I also don't think those schools should be getting any public dollars towards their operation or for getting their customers to their services and I'm not supportive of swapping one for the other.

Choosing to send a kid to private school, reasons are not my business. I tend towards conservative politics. I don't believe it is the government's business either.

Disdain for private choices? Hell no. If the private market will bear it, go for it.

State laws apply to everyone in the state and every school in the state. But you knew tha

I am not convinced she is going to get convicted. When so many other students have known about this for such a long time I think the prosecution is going to have a heck of time proving she did this without his consent. Just think the burden of proof in a criminal case is going to be very difficult. I think there is a lot more to this story that we don't know and the only details right now are the ones the Prosecutor wants people to know.

Doesn't matter if she had his consent. Any sexual contact with a student is a crime according to the law.

Ohio criminalizes sexual contact between high school students and school employees. The statute prohibits any employee of a school from engaging in "sexually explicit conduct" with any student enrolled at the same school

stacey shuler served just over 1 year on 16 counts in Warren County (mason high school).
"Schuler served a little more than one year on her four-year sentence on 16 felony counts of sexual battery."
not sure why Hamilton County would be that much more severe, and women typically get lighter sentences than men anyway

It is not the difference in counties in Ohio, but the difference in the judge. Minimum 12 mos for a F3, up to 60 mos. Early release will depend on the judge and victim.

OP keeps looking for hope. That is bad enough. Not seeing why this is life changing serious for the boy or why there's a problem that "so many knew about it" and it went on... If that is even remotely a correct representation of what happened, they need do some educating in that building.

People are up in arms that these female adult - male child rapes aren't getting the same attention as would male adult. There's going to be pressure and if St X or reps try to mitigate, they'll take a hit. Every priestly event ever is going to be back in the news.

Why did "so many know about it"?? Because guys talk. If a guy gets with a teacher / or aide, it's going to be talked about by the guys.

How someone this stupid get a job at St. X? Dude told her leave me alone and she kept at it including Text. Can't get dumber than that!! You think this guy feels like a Victim? Either way she Violated the Law. No Bail in Hamilton County so she could continue this with someone else until she receives her Prison Sentence!

I didn't ask why so many knew about it. I stated a concern presuming it being factual.

The law she broke doesn't seem to be sexual battery. That was my point. In talking to an criminal defense attorney who is a friend he doesn't think she will go to prison. As of now we only know what the Prosecutor wants us to know and that is her job. If this kid bragged to his friends he banged the Learning Center Tutor how is the prosecutor going to convict her of sexual battery? Point I am trying to make is not to form a strong opinion until we get the rest of the details.

That is what the Prosecutor wants us to know. Always two sides to every story and she will get her day in court. I think she is dumb for hooking up with a high school student and thinking he wouldn't tell his friends.

Wow, the "scandal" even made the Daily Fail in Britain as an " exclusive." I'm sure it will have a terrible effect on the family members ( especially those little kids) no matter what the resolution. Somebody fumigate the stench from the tabloids.
