Bettor sues harness-racing trainer for loss linked to doping

Seems like a slippery slope. If this guy wins, where would it stop? Will positive steroid tests result in lawsuits against MLB, NFL, or the NBA?

Leading figures in harness racing said they had never before heard of such a lawsuit, which accuses the trainer of fraud and racketeering. The general practice is to reallocate the purse to other owners in the event a winning horse is later proven to have been doped, but not to pay back bettors.

The lawsuit, filed Wednesday in U.S. District Court in New Jersey, represents an effort by People for the Ethical Treatment of Animals to open the gates for more litigation by bettors, which the animal rights group hopes would dramatically curtail illegal horse doping. PETA contends that injured horses are sometimes dying on the tracks because they were doped illegally or overmedicated to keep them running when they should be recuperating.

PETA sounds stupid as usual. Over medicated? There is only one drug allowed to be given on race day.

So they're saying the common practice is if one rich guy cheats the other rich guys get to divide up his winnings. But if bet on Lucky Drumbeat in the 7th and he gets caught doping I'm SOL?

Yes do you not see how impractical it would be if they tried to pay you out after the fact?

1st. The tote company would have to hold all payouts until drug testing was done after the race. Then they have to analyze said tests which usually take about 5-7 days for them to have results. Let's say a positive comes up, almost always the trainer will appeal. A split sample will then be tested which will take another 7 days. Then the appeal hewring will happen which could be months to years off. After that process happens the payouts could be made so a year later you will get your gambling winnings.

Also what about false positives, environmental contamination (which happens quite often), what about a minor overage for a therapeutic medication? Should any medication violation result in a change in gambling payout? What about the concern thresholds as which they test at aren't even backed in science? What about the innacuracy of testing for picograms in a 1200 pound animal? What effect does a picogram of any drug have on a race? Minimal at best. What about an overage for non performance enhancing drugs?


So you expect Amtote or any other tote company to hold all of the money that was bet and do payouts by mail or at the track at a later date? It would have to be for all bets taken because you don't know which horses will come up positive until after the fact. Yes that would increase handle and interest in gambling on horses. Come bet with us where you may get your money up to a couple years later!

It sucks that it happens but at the same time the other option is impractical.
